Federal Judge Tosses Ex-CIA Chief Brennan’s ‘Speculative’ Lawsuit Against Trump Admin

A federal judge on Thursday threw out former CIA Director John Brennan’s lawsuit, which sought to compel the Trump administration to preserve records for his defense against potential criminal charges, ruling that he lacked standing.

The Department of Justice is investigating claims that Brennan and other national security officials conspired to undermine President Donald Trump.

The suit, filed in July 2026, sought to compel the Justice Department to retain investigative records so Brennan could prove any indictment against him was the result of vindictive or selective prosecution by the Trump administration.

Judge Jia Cobb, a Clinton-appointed judge, described Brennan’s allegations of political targeting as “deeply concerning,” but determined the claimed injury was “speculative” and not yet imminent, as no indictment has been filed.

Brennan was President Barack Obama’s CIA director from March 2013 to January 2017, and before that, Obama’s counterterrorism adviser.

He is facing indictment in at least two investigations: the broader “grand conspiracy” probe into the 2016 election interference inquiry and a separate case regarding alleged false statements made to Congress in 2023.

Prosecutors in the Southern District of Florida are examining allegations that Obama and Biden-era intelligence and law enforcement officials conspired to deprive President Trump of his civil rights through various investigations, from the 2016 Russia probe and the intelligence community assessment to the Mar-a-Lago classified documents case and related matters.

According to the Republican-led House Judiciary Committee, Brennan “made numerous willfully and intentionally false statements of material fact” during his testimony in 2023, including:

  • Falsely denying that the CIA relied on the discredited Steele dossier in drafting the post-2016 election Intelligence Community Assessment; and

  • Falsely testifying when he told the Committee that the CIA opposed including the Steele dossier in the Intelligence Community Assessment (ICA).

  • These statements were contradicted by the record established by the House Permanent Select Committee on Intelligence (HPSCI) and the CIA, the committee stated in a press release in October 2025.

Newly declassified documents show:

  • A CIA officer drafted the annex containing a summary of the dossier;

  • Brennan made the ultimate decision, along with then-FBI Director James Comey, to include information from the dossier in the ICA; and

  • Brennan overruled senior CIA officers who objected to the inclusion of the dossier material.

The former CIA director argued in his lawsuit that because he planned to contest any prosecution that arises from the DOJ’s probes as vindictive and selective, internal records and communications would be needed to establish that in court.

Brennan alleged that President Trump had singled him out in retaliation for his role in the Russian collusion hoax.

Cobb appeared to that aspect of Brennan’s case seriously, saying that “if he was eventually able to prove those allegations true, that would certainly suggest that his potential prosecution is vindictive.“

But at this point, the judge said it remains to be seen that Brennan is facing enough harm to bring the lawsuit.

“Even taking all of Brennan’s allegations to be truthful at this stage,” the judge wrote, “the injury he alleges is simply too attenuated from the actions he seeks to enjoin to warrant a finding of standing here.”
